Participating OBGYN'S: Notice to Obstetric Patients
Florida law requires that participating physicians and hospitals must give notice to your obstetric patient of your participation in NICA.
A brochure, entitled "Peace of Mind for an Unexpected Problem" has been provided by NICA to each hospital and participating physician. The giving of such brochure to the obstetric patient has been held to satisfy the notice requirement of Florida law. Copies are available free of charge from NICA in 12 different languages.
NICA recommends that your intake personnel be instructed to obtain written, signed notice and patient record notation for your files in order to establish the validity of the giving of notice. NICA personnel will visit and train administrative staff, nurses and doctors at your request.
Physicians and hospitals should rely upon their own legal counsel's interpretation of Section 766.316, Florida Statutes, with regard to providing notice and timeliness of notice, and actions to take in the event a patient refuses to acknowledge receipt of this notice.
